Legal rights and responsibilities

Many parents have told us that legal issues are one of the first concerns they face when going through separation. Unresolved legal proceedings can be stressful and could become a barrier to providing for your child's wellbeing through child maintenance.

If you're separating or living apart from the other parent, you'll need to know what your legal rights are in relation to possessions and legal proceedings. There may be a parental responsibility for your child and you may have a legal responsibility to pay maintenance.

Community Legal Advice (formerly Community Legal Service Direct)

A Government-funded confidential legal service offering free advice to those eligible for legal aid in England and Wales.

Children and Family Court Advisory and Support Service (Cafcass)

Cafcass works with families referred by the courts in England and Wales. Helps families reach agreement over arrangements for their children. Website has useful information, case studies, advice and contact links.

The Law Society of Scotland

The governing body for Scottish solicitors. Promotes solicitors' interests and public interests in relation to legal matters.
