Legal rights and responsibilities

Many parents have told us that legal issues are one of the first concerns they face when going through separation. Unresolved legal proceedings can be stressful and could become a barrier to providing for your child's wellbeing through child maintenance.

If you're separating or living apart from the other parent, you'll need to know what your legal rights are in relation to possessions and legal proceedings. There may be a parental responsibility for your child and you may have a legal responsibility to pay maintenance.

Download our Legal rights and responsibilities [PDF 392KB] PDF leaflet to find out how the law may affect you and your child. The leaflet provides general information about how the law can affect separating parents, and it gives further information on how to get legal advice. It also explains the criteria for getting Legal Aid, which is free professional help with legal matters.

Starting to deal with legal issues can seem daunting at first. But understanding your rights and responsibilities will help you plan for you and your child with more confidence.
